« OVV » means Voluntary Sales Operator DEBURAUX PARIS SAS
The word « lot » means the material or materials presented for sale.
CONDITIONS FOR PARTICIPATION IN SALES
Any public may participate in the sale with the exception of natural or legal persons, nationals of countries sibject to internationa sanctions.
The auctionner accepts bids from:
- Internet bidders
- telephone bidders
- commission bids or absentee bids
-bidders in the saleroom
Any person wishing to participate in the sale must make himself known at the latest the day before the sale by indicating to the OVV his identity and address.
The last bidder will be considered as the successful bidder responsible for payment. He will have to declare his identity and address to the OVV.
If the bidder is acting on behalf of others, he must present an identity document, a mandate to act and the documents identifying his proxy.
II. FEES AND PAYMENT
In addition of the lot’s hammer price, the buyer must pay the different stages of following costs and fees/ taxes :
-From 1 to 1, 000, 000 euros : 11.90% + current VAT
-From 1,000, 001 to 1, 500, 000 euros : 8% + current VAT
-From 1, 500, 001 to 2, 000, 000 euros : 6% + current VAT
-Over 2, 500, 001 euros : 3% + current VAT
Inter-bidding fees of 3% excl. taxes or 3.6% incl. taxes will be collected, in addition, for bidders who bid via this site
The payment of the lot will be made cash.
The lot will be delivered to the buyer only after the entire payment of the price, costs and taxes.
Payment will be made by bank transfer (details of your bank account attached)
III. SURETY BOND
No deposit is required if you want to bid a single lot, excepted for the lot 8.
However a deposit of 100,000 euros is required for bidders who plan to participate in the auction for lot 8 or all material presented at the auction.
The amount of this deposit must be paid by bank transfer to the account whose details are mentioned below, at the latest one working day before the sale.
This deposit will be refunded without deduction of costs to the persons not awarded as soon as the sale is completed.
This deposit will not reduce the lot’s price.
IV. GUARANTEE
The material is sold in the state in which it is, without complaint and for scrap; and this, even if it was presented turning, on or under tension during the visits.
A preliminary visit allowing the purchasers to be aware of the state of the goods put up for sale, no claim will be admitted once the auction is pronounced.
The sales operator shall be at the disposal of the persons concerned in order to transmit to them any information in his possession, or additional photographs which they consider useful, provided that their request is received by the sales operator at least five working days before the day of the sale.
All information relating to an incident, accident, or damage affecting the lots shall be communicated in order to facilitate their inspection by the potential buyer and shall remain subject to the latter’s full assessment.
The absence of any indication of an incident, accident or damage does not imply that a lot is free from defects. Indications of lack, defect or damage are not exhaustive.
V. RESPONSIBILITIES DURING VISITS
Visits require personal protective equipment (PPE: safety helmet, safety shoes and covering clothing). Visitors will need their own equipment. They will have to comply with the safety instructions that will be given to them on site. In case of accident during the visit the responsability of the company l'Entrepose, Arverne Drilling or the OVV would not be incurred.
VI. THE SALE
The order of the catalogue will be followed.
The right of withdrawal does not apply in this sale.
The auction will be done with faculty of meeting: each of the lots will be sold with a provisional auction. Once all lots are provisionally awarded, the auctioneer will announce to the public the total amount of these auctions. If a bidder raises an auction above this amount, the provisional auction will be cancelled and the auctioneer will sell all the material in a single lot. All the public will then be able to bid beyond that.
VII. PURCHASE ORDER
Purchase order (also known as absentee bids or commission bids) left with us by a bidder before the auction later than two working days before the sale accompanied by bank details
Should Deburaux Paris SAS receive several instructions to bid for the same amounts, it is the
instruction to bid first received which will be given preference.
In the case of a order of the same amount as an auction carried at the place of sale, priority will be given to the purchase order.
VIII. PHONE BIDS
Your request for this service must be made no later than two working days before the auction and accompanied by your bank details. We will accept bids by telephone for lots only if our staff are available to take the bids. The OVV may in no case be held responsible if the applicant cannot be contacted by telephone at the time of the sale, for any reason whatsoever.
IX. INTERNET
Any person will be allowed to attend and/or participate in the online sale according to the terms and conditions set out on the website.
The registration for the sale will be closed on April, 21, 12 am.
X. LIABILITY AFTER AUCTION
The contractors undertake to carry out any repair, repair and regulatory control before any use of the equipment acquired during the sale. The successful bidders will be responsible for their lot as soon as the contract is awarded. The acquirer will himself be responsible for insuring his acquisitions, and the OVV declines any liability for damages that the lot could incur. Lots may be issued to them subject to payment and by appointment.
The removal operations will be under the control of the company Arverne Drilling, which will be able, on request and on estimate, to perform operations of lifting, putting in truck, or on carrier.
During these operations, the seller and the sales operator shall not be liable.
XI. WITHDRAWAL OF PURCHASES
Successful bidders are advised to remove their lots as soon as possible in order to avoid the storage costs borne by them. Storage is not the responsibility of the OVV or the seller.
The lots can be withdrawn, free of charge, for 90 days after the sale, or until July 20, 2022.
After this period, a storage fee of €1,000 excluding tax ( ?) per day and per batch will be collected. Payment of this sum shall in no way exempt the successful tenderer from the above liability clauses.
The award of the prizes will be deferred until the successful tenderer receives the sums due.
XII. EXPORTATION
The buyer shall have recourse to all regulatory, administrative and customs procedures with a view to exporting all or part of the material acquired.
In any event, the undertake not to export these materials to countries subject to international sanctions.
No to sell them to nationals of those countries.
In the event of non-compliance with these commitments, the OVV and the seller cannot be held liable.
XIII. LAW AND JURISDICTION
These terms and conditions are subject to the provisions of French law. Law No. 2011-850 of 20 July 2011 is the regime applicable to voluntary sales of furniture at public auctions.

In accordance with the law, it is added that all actions in public liability instituted on the occasion of valuation and of voluntary and court-ordered auction sales are barred at the end of five years from the hammer price or valuation. These Conditions of purchase are governed by French law exclusively.
Any dispute relating to their existence, their validity and their binding effect on any bidder or buyer shall be submitted to the exclusive jurisdiction of the Courts of France.
